An Appeal Reviews a Judges Decision
Video Transcribed: What exactly is an appeal? Hi, I’m Eric Strocen. I’m an attorney in Muskogee, Okla, with the Wirth Law Offices, and I’m here to talk to you today about this important topic.
We are talking about the right to appeal, the right to have a panel of judges reviews the case, and what happened below at the trial level, where the case first started. This is an important right because no one is perfect.
Remember, judges are people, juries are people, and things don’t always get conducted in the way ideal for the system to ensure you get justice at the trial level. Therefore, in this country, we have an appeal process that allows for other eyes to get on it. And those eyes, usually, are experienced in seeing those because they’ll see them so much.
Typically, in Oklahoma, we are not seeing a lot of issues get brought up and have oral arguments, because that is usually reserved for really novel issues in which the law might change. So not everyone on appeal gets a second hearing.
What happens there is they are confined to reviewing the record of your proceeding. Make sure the objections were appropriate, that the judge’s rulings on them were fair and within the law, and making sure that you were treated fairly throughout the process.
