What is adverse possession under Oklahoma law? I am Muskogee Attorney Eric Strocen, with the Wirth Law offices and I’m here to explain. Adverse possession requires that someone who is not the record title owner actually occupies spaces if they’re the owner on someone else’s land.
That occupation must be open and notorious. They must be doing it exclusively, as in they’re not sharing with the owner. They are themselves asserting that they are the owner of this piece of land.
They could not have gotten permission to be there. And it has to be continuous. It has to be something that was uninterrupted. Their occupation must have been there for the statutory period under Oklahoma law.
