How Does the Law Define Marriage? Hi, I’m Muskogee Attorney Eric Strocen with the Wirth Law Offices. Marriage is a civil union arising out of a contract between two people.
Your right to marry whom you please is a protected fundamental right under the Constitution of the United States. That is something that has been in the media a lot lately and we hear a lot of things about it.
Under Oklahoma law, the definition of marriage is found in Title 43, and you really only need three things. One, you need a union arising out of the contract; two, legally competent parties, meaning that they’re legally competent, they’re able to consent; and then three, that the marriage doesn’t violate any Oklahoma law, meaning that there can’t be a union that is not protected under the law.
