Can you get attorney’s fees in family law cases? Hi, I’m Muskogee Lawyer Eric Strocen here to talk to you today about this topic.
The answer is yes. Attorney’s fees, what we call fee-shifting statutes in the law, they’re present in Oklahoma, and under certain circumstances, you may be awarded them in your family law case.
The thing to note is, especially if we’re talking about divorces, you need to understand that the judge has the discretion to determine if they’re appropriate. And then, the fight is what’s reasonable, meaning I as your attorney would be turning in a list of what I’ve done for you and justifying that fee that the other person is to pay.
As I said, it’s a totality of the circumstance analysis and it’s something separate from your family law case that we would be arguing over in a miniature trial.
