Understanding the Length of Divorce Proceedings in Oklahoma
Hi, this is Muskogee divorce attorney Justin Mosteller, and today we’re going to talk about how long a divorce takes in the state of Oklahoma. This question varies from case to case, but it’s probably the one I hear most often when people call for help with a divorce. The main factor that determines how long a divorce takes is the complexity of the case. Factors that make a case more complex include the presence of children and extensive property, particularly if there is a business that needs to be dissolved.
As a general rule, if children are involved, there is a 90-day waiting period before a divorce can be granted. This period begins the day the petition is filed, and the judge cannot finalize the divorce until 90 days have passed. The waiting period can be waived, but only if there are circumstances that justify it. For example, I once had a client who was being deployed to a war zone. Because of the urgency, the judge waived the 90-day requirement. Outside of such circumstances, you should expect at least a 90-day wait.
Factors Affecting the Timeframe
The more complicated your divorce is, the longer it will take. Unfortunately, divorces can take quite a lot of time, especially in counties with a heavy caseload, where securing court time can be difficult.
The main thing to remember is that while you don’t want to rush the process to the point where mistakes are made, the sooner the case is resolved, the better.
